You should know before you read this that some very knowledgeable people in one of the US groups to which I subscribe are questioning some of the details Arthur has stated re. the FCC’s indemnification of telecoms against lawsuits associated with injury, death or property damage.
In Canada, ISED indemnifies telecoms from lawsuits so long as their products’ emissions are below Safety Code 6 levels. This means that cell phone companies that make and sell the many phones with emissions exceeding SC 6 levels could be sued. Hopefully, they will be, very soon.

We are asking the Supreme Court to rule on two related questions:
1. Does Section 704 of the Telecommunications Act of 1996 violate the right of access to courts guaranteed by the First Amendment of the Constitution?
2. Does “environmental effects” mean “health effects” in Section 704?”
